Personal data<\/h3><p>Personal data means any information relating to an identified or identifiable individual; an identifiable individual is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that individual.<\/p><h3>4. Purposes of processing and grounds for data processing<\/h3><p>The organisation collects and processes your personal data on the following legal bases:<\/p><ul><li>processing is necessary for compliance with a <strong>legal obligation<\/strong> to which the controller is subject;<\/li><li>processing is necessary for the <strong>performance of a contract<\/strong> to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract;<\/li><li>processing is necessary for the purposes of the <strong>legitimate interests<\/strong> pursued by the controller or by a third party;<\/li><li>the data subject has <strong>given consent<\/strong> to the processing of his or her personal data for one or more specific purposes;<\/li><li>processing is necessary in order to <strong>protect the vital interests<\/strong> of the data subject or of another natural person.<\/li><\/ul><p><strong>4.1) Compliance with a legal obligation<\/strong><\/p><p>Based on the provisions of the law, the organisation processes data about its employees as permitted by labour and social security legislation. On the basis of a legal obligation for employment purposes, the organisation primarily processes the following types of personal data: first and last name, gender, date of birth, personal identification number (EM\u0160O), tax number, place, municipality, and country of birth, citizenship, residence, etc. The legal basis for the processing of personal data of individuals is also: The Cultural Heritage Act, the Promotion of Tourism Development Act, the Protection of Documents and Archives and Archival Institutions Act, and other legislation in the field of culture. In limited cases, the organisation is also permitted to process personal data on the basis of public interest. All applicable sectoral regulations in the field are collected on the website of the competent ministry: https:\/\/www.gov.si\/drzavni-organi\/ministrstva\/ministrstvo-za-kulturo\/zakonodaja\/<\/p><p><strong>4.2) Performance of a contract<\/strong><\/p><ul><li>In the event that an individual enters into a specific contract with the organisation, this represents the legal basis for the processing of personal data. We may thus process personal data for the conclusion and performance of a contract, such as the sale of tickets, etc. If the individual does not provide personal data, the organisation cannot conclude the contract, nor can the organisation perform the service or deliver goods or other products in accordance with the concluded contract, as it lacks the necessary data for execution. On the basis of the legitimate pursuit of its activities, the organisation may inform individuals and users of its services via their email address about its services, events, training, offers, and other content. An individual may at any time request the termination of such communication and processing of personal data and cancel the receipt of messages via the unsubscribe link in the received message, or as a request by email to <em>loz@zavod-sneznik.si<\/em> or by regular mail to<\/li><\/ul><p><em>Sne\u017enik Public Institute for Culture, Tourism, and Intergenerational Cooperation, Cesta Notranjskega odreda 24, 1386 Stari trg pri Lo\u017eu.<\/em><\/p><p><strong>4.3) Legitimate interest<\/strong><\/p><p>The organisation may also process personal data on the basis of the legitimate interest for which it strives. The latter is not permissible where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. In the case of using legitimate interest, the organisation always carries out an assessment in accordance with the General Regulation. The processing of personal data of individuals for the purposes of direct marketing is considered to be carried out in the legitimate interest. The organisation may process personal data of individuals collected from publicly available sources or within the framework of the lawful performance of activities, also for the purposes of offering goods, services, employment, informing about benefits, events, etc. To achieve these purposes, the organisation may use regular mail, telephone calls, email, and other telecommunication means. For the purposes of direct marketing, the organisation may process the following personal data of individuals: first and last name of the individual, address of permanent or temporary residence, telephone number, and email address. The organisation may process the stated personal data for the purposes of direct marketing even without the explicit consent of the individual. An individual may at any time request the termination of such communication and processing of personal data and cancel the receipt of messages via the unsubscribe link in the received message, or as a request by email to <em>tic.loz@zavod-sneznik.si<\/em> or by regular mail to: <em>Sne\u017enik Public Institute for Culture, Tourism, and Intergenerational Cooperation, Cesta Notranjskega odreda 24, 1386 Stari trg pri Lo\u017eu.<\/em><\/p><p><strong>4.4) Processing based on consent<\/strong><\/p><p>If the organisation does not have a legal basis demonstrated on the basis of the law, a contractual obligation, or a legitimate interest, it may ask the individual for consent. Thus, it may also process certain personal data of the individual for the following purposes, when the individual provides consent for this:<\/p><ul><li>residential address and email address for the purposes of notification and communication;<\/li><li>photographs, video recordings, and other content relating to the individual (e.g. publishing images of individuals on the organisation&#8217;s website) for the purposes of documenting activities and informing the public about the work and events of the organisation;<\/li><li>other purposes for which the individual agrees by giving consent.<\/li><\/ul><p>If an individual gives consent for the processing of personal data and at some point no longer wishes this, they can request the termination of the processing of personal data with a request by email to tic.loz@zavod-sneznik.si or by regular mail to: <em>Sne\u017enik Public Institute for Culture, Tourism, and Intergenerational Cooperation, Cesta Notranjskega odreda 24, 1386 Stari trg pri Lo\u017eu.<\/em> The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.<\/p><p><strong>4.5) Processing is necessary to protect the vital interests of the individual<\/strong><\/p><p>The organisation may process the personal data of the data subject if this is necessary to protect their vital interests. In urgent cases, the organisation may search for an individual&#8217;s personal document, check whether this person exists in its database, examine their medical history, or establish contact with their relatives, for which the organisation does not require the individual&#8217;s consent. The above applies in cases where it is strictly necessary to protect the vital interests of the individual.<\/p><h3>5. Storage and erasure of personal data<\/h3><p>The organisation will store personal data only for as long as is necessary to fulfil the purpose for which the personal data was collected and processed. If the organisation processes data based on the law, it will store it for the period prescribed by law. In this context, some data is stored for the duration of the cooperation with the organisation, while some data must be stored permanently. Personal data processed by the organisation on the basis of a contractual relationship with an individual is stored by the organisation for the period necessary for the execution of the contract and for 6 years after its termination, except in cases where a dispute arises between the individual and the organisation regarding the contract. In such a case, the organisation stores the data for 10 years after the finality of a court decision, arbitration, or court settlement or, if there was no legal dispute, 5 years from the date of the peaceful resolution of the dispute. Personal data processed by the organisation on the basis of the individual&#8217;s personal consent or a legitimate interest will be stored by the organisation until the consent is withdrawn or until a request for data deletion is made. Upon receipt of a withdrawal or a request for deletion, the data shall be deleted within 15 days at the latest. The organisation may also delete this data before withdrawal when the purpose of processing the personal data has been achieved or if so provided by law.<\/p><p>Exceptionally, the organisation may refuse a request for deletion for reasons set out in the General Regulation, such as: exercising the right to freedom of expression and information, compliance with a legal obligation to process, reasons of public interest in the field of public health, archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, and the establishment, exercise, or defence of legal claims. After the expiry of the storage period, the organisation must effectively and permanently delete or anonymise the personal data so that it can no longer be linked to a specific individual.<\/p><h3>6. Contractual processing of personal data and data transfer<\/h3><p>The organisation may entrust individual processing of personal data to a contractual processor on the basis of a contractual processing agreement. Contractual processors may process the entrusted data exclusively on behalf of the controller, within the limits of their authorisation as set out in a written contract or other legal act, and in accordance with the purposes defined in this privacy policy.<\/p><p>The contractual processors with whom the organisation cooperates are primarily:<\/p><ul><li>accounting services and other providers of legal and business consultancy;<\/li><li>infrastructure maintainers;<\/li><li>IT system maintainers;<\/li><li>email service providers and providers of software and cloud services (e.g. Arnes, Microsoft, Google);<\/li><li>social network and online advertising providers (Google, Facebook, Instagram, etc.).<\/li><\/ul><p>Under no circumstances will the organisation provide an individual&#8217;s personal data to unauthorised third parties. Contractual processors may only process personal data within the framework of the organisation&#8217;s instructions and may not use the personal data for any other purposes.<\/p><p>The organisation, as the controller, and its employees do not transfer personal data to third countries (outside the member states of the European Economic Area \u2013 EU member states plus Iceland, Norway, and Liechtenstein) or to international organisations, except to the USA, whereby relationships with contractual processors from the USA are regulated on the basis of standard contractual clauses (model contracts adopted by the European Commission) and\/or binding corporate rules (adopted by the organisation and approved by the supervisory authorities in the EU).<\/p><p>For the purposes of better oversight and control over contractual processors and the regulation of mutual contractual relationships, the organisation maintains a list of contractual processors, which lists all specific contractual processors with whom the organisation cooperates<\/p><h3>7. Cookies<\/h3><p>The organisation&#8217;s website operates with the help of so-called cookies. A cookie is a file that stores website settings. Websites store cookies on the devices users use to access the internet in order to identify individual devices and the settings users applied during access. Cookies allow websites to recognise if a user has already visited the site. In advanced applications, they can be used to appropriately adjust individual settings. Their storage is under the complete control of the browser used by the individual \u2013 the user can restrict or completely disable the storage of cookies as desired.<\/p><p>Cookies are crucial for the provision of user-friendly web services. Data protection and data accuracy<\/h3><p>The organisation ensures information security and the security of the infrastructure (premises and application-system software). Our information systems are protected by, among other things, anti-virus programmes and a firewall. We have implemented appropriate organisational and technical security measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access, and against other unlawful and unauthorised forms of processing. In the case of transmitting special categories of personal data, we transmit them in encrypted form and protected by a password.<\/p><p>The individual is solely responsible for providing their personal data securely and for ensuring that the data provided is accurate and authentic. The organisation will strive to ensure that the personal data it processes is accurate and updated as necessary; it may occasionally contact the individual to confirm the accuracy of the personal data.<\/p><h3>9. Individual rights regarding data processing<\/h3><p>In accordance with the General Regulation, the individual has the following personal data protection rights:<\/p><ul><li>The right to request information on whether we hold their personal data and, if so, what data we hold, on what basis we hold it, and why we use it;<\/li><li>the right to request access to their personal data, which allows them to receive a copy of the personal data held by the organisation and to verify whether the organisation is processing it lawfully;<\/li><li>the right to request corrections to personal data, such as the correction of incomplete or inaccurate personal data;<\/li><li>the right to request the erasure of their personal data when there is no reason for further processing or when exercising their right to object to further processing;<\/li><li>the right to object to the further processing of personal data where the organisation relies on a legitimate business interest (including in the case of a third party&#8217;s legitimate interest), when there are reasons related to the individual&#8217;s particular situation; the individual has the right to object at any time if the organisation processes personal data for direct marketing purposes;<\/li><li>the right to request the restriction of the processing of their personal data, which means the suspension of the processing of personal data, for example, if the individual wants the organisation to establish accuracy or to verify the reasons for further processing of personal data;<\/li><li>the right to request the transfer of their personal data in a structured electronic format to another controller, insofar as this is possible and feasible;<\/li><\/ul><ul><li>the right to withdraw the consent or agreement they provided for the collection, processing, and transfer of their personal data for a specific purpose; upon receiving notification that they have withdrawn their consent, the organisation will cease processing the personal data for the purposes for which it was originally accepted, unless the organisation has another legitimate basis for doing so legally.<\/li><\/ul><p>If an individual wishes to exercise any of the aforementioned rights, they can send a request by email to <em>tic.loz@zavod-sneznik.si<\/em> or by regular mail to the <em>Sne\u017enik Public Institute for Culture, Tourism and Intergenerational<\/em> <em>Cooperation, Cesta Notranjskega odreda 24, 1386 Stari trg pri Lo\u017eu.<\/em> The organisation will respond to a request relating to an individual&#8217;s rights without undue delay and in any case within one month of receiving the request. In the event that this period is extended (by a maximum of two additional months) taking into account the complexity and number of requests, you will be notified accordingly.<\/p><p>Access to an individual&#8217;s personal data and the exercise of rights is free of charge for the individual. However, the organisation may charge a reasonable fee if the request from the individual to whom the personal data relates is clearly unfounded or excessive, especially if it is repetitive. In such a case, the organisation may also refuse the request. In the event of exercising rights under this section, the organisation may need to request certain information from the individual to help confirm the individual&#8217;s identity, which is only a security measure to ensure that personal data is not disclosed to unauthorised persons.<\/p><p>When exercising rights under this section, the individual may use the form from the Information Commissioner, which is available on their website.
